RENTAL WAIVER

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE RENTING ANY EQUIPMENT FROM ELITE AIRSOFT RENTALS. By completing a reservation, paying a deposit, accepting rental equipment, or participating in any activity facilitated by Elite Airsoft Rentals, you ("the Renter") acknowledge that you have read, fully understood, and agree to be legally bound by all terms and conditions set forth in this Agreement. If you do not agree to these terms, do not proceed with your reservation or accept rental equipment.

Section 1

Assumption of Risk & Liability Waiver

IMPORTANT NOTICE: Airsoft is a contact sport involving replica firearms that discharge plastic projectiles at high velocity. Participation carries inherent risks of physical injury. By renting equipment from Elite Airsoft Rentals and participating in any airsoft activity, you voluntarily assume all such risks.

The Renter expressly acknowledges and agrees that Elite Airsoft Rentals, its owner(s), agents, employees, and representatives are not responsible, liable, or accountable in any way for any injury, harm, illness, death, or property damage sustained by the Renter or any third party arising from or in connection with the use of rented equipment, participation in airsoft activities, or presence at any partner field location.

This waiver of liability applies to, but is not limited to, the following circumstances:

Physical injuries resulting from being struck by airsoft projectiles, including but not limited to bruising, welts, lacerations, eye injury, or teeth injury

Injuries caused by the Renter's own actions, negligence, or failure to follow safety instructions

Injuries caused by the actions of other players, field staff, or third parties not affiliated with Elite Airsoft Rentals

Injuries resulting from the use, misuse, or malfunction of rented equipment

Injuries sustained on field premises, including terrain-related incidents such as trips, falls, or collisions

Any physical or emotional harm arising from participation in gameplay scenarios

Medical conditions aggravated by physical exertion during gameplay

The Renter agrees to indemnify, defend, and hold harmless Elite Airsoft Rentals and its owner(s) from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to the Renter's participation in any activity facilitated by Elite Airsoft Rentals, regardless of the cause.

The Renter acknowledges that they are participating voluntarily, are physically capable of engaging in airsoft activities, and have not been advised by a medical professional to avoid strenuous physical activity.

Section 2

Proper Use of Equipment & Mandatory Safety Gear

By accepting rental equipment from Elite Airsoft Rentals, the Renter agrees to use all provided equipment in a safe, responsible, and lawful manner at all times. The Renter further agrees to the following conditions:

The Renter will wear all safety gear provided with the rental — including full-face protection mask and any other protective equipment included — for the entire duration of active gameplay. Removal of safety gear during live play is strictly prohibited.

The Renter will operate rented equipment only in designated play areas as directed by field staff, and will comply with all field rules and safety regulations at all times.

The Renter will not modify, disassemble, alter, or tamper with any rented equipment in any way.

The Renter will not point rented equipment at any person outside of designated gameplay areas or in a manner not consistent with the rules of play established by the field.

The Renter will handle all equipment with reasonable care and will return all items in the same condition in which they were received, subject to normal wear and tear.

The Renter will follow all instructions provided by Elite Airsoft Rentals, field staff, or field management regarding the use, handling, and return of rental equipment.

Rental equipment is intended solely for use in organized airsoft gameplay at the designated partner field location. Use of rented equipment outside of approved field premises is strictly prohibited.

Failure to comply with any of the above conditions may result in immediate termination of the rental, forfeiture of any deposits paid, and the Renter being held financially responsible for any resulting damage or loss.

Section 3

Equipment Orientation & Demo Video

Elite Airsoft Rentals provides renters with access to a demonstration video explaining how to properly operate, handle, and maintain the rented equipment during their session. This video is made available to all renters prior to or at the time of equipment pickup. Scan the QR code on the Rental Gun to watch the demonstration video.

The Renter acknowledges that they are responsible for viewing the provided demonstration video and familiarizing themselves with the safe operation of all rented equipment before beginning play. By accepting the equipment, the Renter represents that they have had adequate opportunity to review the demo materials and understand how to operate the equipment safely.

Elite Airsoft Rentals strongly encourages all renters — especially first-time players — to watch the full demonstration video before handling any equipment. If the Renter has questions about equipment operation not answered by the demo video, they should contact Elite Airsoft Rentals prior to their rental date or speak with field staff on-site before beginning play.

The availability of a demonstration video does not limit or replace the Renter's obligation to use equipment responsibly and in accordance with all safety guidelines outlined in this Agreement.

Section 4

Equipment Malfunctions & Technical Issues

The Renter understands and acknowledges that mechanical breakdowns, misfires, feeding issues, and other malfunctions are a common and inherent characteristic of airsoft equipment, including well-maintained rental units. Elite Airsoft Rentals makes every reasonable effort to inspect, charge, and test all equipment prior to delivery, but cannot guarantee uninterrupted performance during use.

In the event that rented equipment experiences a malfunction or breakdown during the rental session, the Renter agrees to take the following steps:

Immediately cease use of the malfunctioning equipment and ensure the equipment is pointed in a safe direction before setting it down.

Notify field staff or the field manager on-site. Field personnel are the first point of contact for any issues occurring during your session and may be able to assist with basic troubleshooting or facilitate communication.

The Renter agrees not to attempt to repair, disassemble, or forcibly operate malfunctioning equipment. Elite Airsoft Rentals is not obligated to provide a replacement unit during the rental session but will make reasonable efforts to resolve issues in a timely manner. Refunds or credits for equipment malfunctions will be evaluated on a case-by-case basis at the sole discretion of Elite Airsoft Rentals.

Section 5

Renter Liability for Damage & Loss

The Renter accepts full financial responsibility for any damage to or loss of rented equipment that occurs during their rental period, beyond what constitutes normal wear and tear from standard gameplay use.

Excessive damage includes but is not limited to: cracked or broken receiver bodies, damaged internals resulting from improper use, shattered or damaged optics, broken magazines, bent or damaged barrels, and any other damage determined by Elite Airsoft Rentals to have resulted from misuse, negligence, or failure to follow operating guidelines.

Loss includes failure to return any rented item — including but not limited to the primary airsoft rifle, magazines, BBs, protective mask, tactical accessories, and any other items included in the rental package.

In the event of excessive damage or loss of any rental unit or accessory, the Renter will be charged the full replacement cost of the damaged or lost item(s) at current market value, as determined solely by Elite Airsoft Rentals. By agreeing to these terms, the Renter authorizes Elite Airsoft Rentals to charge the payment method on file for any such amounts owed.

A credit card or payment method must be on file at the time of equipment pickup to serve as security against potential damage or loss. This information will be held securely and will only be charged in accordance with the terms of this Agreement.

Elite Airsoft Rentals reserves the right to document the condition of equipment at the time of delivery and upon return. Renters are encouraged to inspect their equipment upon receipt and report any pre-existing damage to field staff or Elite Airsoft Rentals immediately. Failure to report pre-existing damage before gameplay begins may result in the Renter being held responsible for that damage upon return.

Section 6

Cancellation & Refund Policy

Elite Airsoft Rentals requires advance notice for all cancellations. The following policy applies to all reservations:

Cancellations made more than 48 hours before the scheduled rental date are eligible for a full refund of the deposit paid at the time of booking.

Cancellations made less than 48 hours before the scheduled rental date are non-refundable. However, the deposit paid will not be forfeited — it will be applied as a credit toward a future reservation on a different available date, subject to availability. Deposit credits do not expire but are non-transferable and have no cash value.

No-shows — defined as failure to appear at the designated field on the scheduled rental date without prior cancellation notice — will be treated as a late cancellation. The deposit will be converted to a rental credit under the same terms described above.

Cancellations must be submitted in writing by email to eliteairsoftrentals@gmail.com with the Renter's name, reservation date, and field location. Cancellation requests made by phone, text, or through field staff will not be accepted as official notice. The cancellation is effective upon written confirmation from Elite Airsoft Rentals.

Elite Airsoft Rentals reserves the right to cancel or reschedule a reservation in the event of circumstances beyond its control, including but not limited to severe weather, field closures, or equipment unavailability. In such cases, the Renter will be offered a full refund or the option to reschedule at no additional cost.

Section 7

Age Requirements & Parental Consent

Renters must be at least 18 years of age to enter into this Agreement independently. Renters between the ages of 11 and 17 may participate only with the written consent of a parent or legal guardian, who must also sign this Agreement and accept all terms on the minor's behalf. The parent or guardian assumes full legal and financial responsibility for the minor's compliance with this Agreement.

Renters under the age of 11 are not permitted to rent equipment from Elite Airsoft Rentals without explicit written approval from Elite Airsoft Rentals, in addition to parental consent. Participation of minors is ultimately subject to the rules and age requirements of the partner field at which the activity takes place.

Section 8

Payment Terms

Reservations are secured by a deposit paid online at the time of booking. This deposit represents Elite Airsoft Rentals' portion of the rental fee. The remaining balance of the rental cost is due and payable directly to the partner field upon the Renter's arrival on the scheduled rental date. Elite Airsoft Rentals does not collect the remaining balance — all on-site payments are handled exclusively by field staff.

Deposits are non-transferable to other individuals and may only be applied to reservations made under the original Renter's name. All prices are listed in U.S. dollars and are subject to change without notice. The price displayed at the time of booking will be honored for that reservation.

Section 9

Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the states in which Elite Airsoft Rentals operates, including but not limited to the States of Illinois, Wisconsin, Iowa, and Indiana, without regard to conflict of law provisions. The applicable state law shall be determined by the state in which the rental activity takes place. Any disputes arising under or in connection with this Agreement shall first be submitted to good-faith negotiation between the parties. If a resolution cannot be reached informally, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

The Renter agrees that any claims brought against Elite Airsoft Rentals shall be made in the Renter's individual capacity and not as a plaintiff or class member in any purported class or representative action. The Renter waives any right to a jury trial in connection with any dispute arising under this Agreement.

Section 10

Severability & Entire Agreement

If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.

This Agreement constitutes the entire agreement between the Renter and Elite Airsoft Rentals with respect to the rental of equipment and supersedes all prior or contemporaneous communications, representations, or agreements, whether written or oral. Elite Airsoft Rentals reserves the right to update or modify these terms at any time. The version in effect at the time of the Renter's reservation will govern that transaction.
